Wills, Trusts and Probate Disputes
Thankfully disputes over Wills, Probates and Trusts are not too common. However, when they do happen they can be very upsetting for all of the people involved - particularly for the next of kin.
Whilst the law acknowledges a person’s right to determine where to leave their property and assets on death, Wills can still face challenges - and in addition claims for financial provision can be made under the Inheritance (Provision for Family and Dependants) Act, 1975.
Therefore, following a person’s death a dispute may arise as to the validity of their last Will which may require Court proceedings to resolve those issues and determine whether the Will should be admitted to probate.
