GROUNDS FOR DIVORCE

The only ground for divorce is that the marriage has irretrievably broken down.

This ground must be proved by one of the following facts:-

  • Adultery
  • Unreasonable Behaviour
  • Desertion for 2 years
  • Living separately for 2 years and your spouse agrees to the divorce
  • Living separately for 5 years whether or not your spouse agrees

If you decide to proceed and to issue divorce proceedings against your spouse or indeed you have been served with divorce proceedings those documents will be lodged with the court.

The court then considers the documentation and will award a Decree Nisi if it accepts that the documentation has proved your marriage has irretrievably broken down

The second stage is six weeks after this when a Decree Absolute will be issued. This is the final stage and proof that you are divorced.
